Islamabad (Big Digit)(PR)The Islamabad High Court has issued a directive not to harass him in a writ petition filed by Afghan citizen Lal Agha for marrying a Pakistani woman, Maryam Jalal.
The legal team comprising advocates Azmat Ali Mubarak, Tahira Bano Mubarak, Uzma Mubarak and Asghar Ali Mubarak, appearing for the petitioner Afghan citizen, argued that despite submitting all the required documents, the respondents failed to issue a citizenship certificate in violation of the Pakistani Citizenship Act 1951 and the Constitution and violated their fundamental rights under Articles 4 and 25. The lawyers took the position that foreigners who marry Pakistanis are entitled to Pakistani citizenship, while their children have also been granted citizenship. Afghan citizen Lal Agha married a Pakistani woman Maryam Jalal and is the father of 3 minor children. He is being deported under the notification dated July 04, 2025. The Afghan citizen requested for suspension of the notification so that the final decision on the extension of the Afghan registration card and the petitioner’s application for issuance of Pakistani citizenship certificate can also be decided and requested that Afghan citizen Lal Agha be restrained from harassing him.
The lawyers submitted that if this court directs the respondents to decide the application for issuance of pending Pakistani citizenship certificate by granting all rights to the petitioner as per law, then the petitioner will be satisfied. After the arguments of the lawyers Advocate Azmat Ali Mubarak, Tahira Bano Mubarak, Uzma Mubarak, Islamabad high court Mr Justice Muhammad Azam Khan directed the respondents to decide the application for issuance of pending Pakistani citizenship certificate in the interest of justice and said that the Afghan citizen should not be harassed.
